Permanent Site Lease

1. Happy Acres
Resort agrees to lease to the Tenant, site # ____________________
located in Happy Acres Resort.
2. The lease term shall
be on a month-to-month basis beginning _______________20 _____.
3. The tenant agrees
to pay Happy Acres Resort, rent for site leased, in the amount
of $________per year in advance and/or monthly installments in the
amount of $__________due on the 1st day of each month, beginning
on
______, 20 ___. A late fee of $50 will be charged for rent
not received by the 5th of the month.
4. The tenant also
agrees to pay Happy Acres Resort a one time emergency security
deposit in the amount of
$______.
5. If lot rent is
not paid, tenant agrees to have property and all personal
belongings removed off of Happy Acres Resort property upon given a
30-day notice.
6. Happy Acres
Resort must be notified when the Tenants unit is for sale.
NO FOR SALE SIGNS ALLOWED ON YOUR LOT OR BUILDING. All sales must be
posted in the office. You must get prior approval to sell unit with
site rental, and all buyers must be interviewed and approved by Happy
Acres Resort owner to rent the site. Lot rent cannot be
transferred or refunded. Lot rent is due the day of settlement.
7. Termination of
Contract: Contracts can be terminated without a refund by
owner for violations of Happy Acres Resort rules, such as but not
limited to, non-payments, unruly behavior, fighting and domestic
activities.
8. The tenant agrees
to use the premises for Recreational Use Only and does certify
that the site cannot be used by anyone not listed on this lease
agreement, without prior permission from Happy Acres Resort. There will
be no subletting.
9. Tenants must be
approved by owner and registered at office as tenant of their
site. Parents must accompany children under age 21 that are
staying in their unit. No student groups or house parties of any kind
permitted.
10. Tenants will
receive a car pass; this is for your protection so that our
managers will recognize when unauthorized vehicles are on the premises.
Car passes must be displayed on your vehicle. They will be
available at the office.
11. All visitors
paying and non-paying must register at the office and receive a
car pass. There is a $10 fee for each overnight visitor.
There is an $8.00 charge for all visitors’ pets. These charges are to
off set the expenses of security, insurance, maintenance etc. You
are responsible to register your visitors. No non-paying visitors
allowed after 10:00pm. No large parties, loud music or unruly
behavior will be allowed.
12. Parking is
limited to your own site, if there is not enough room, you must
park extra vehicles in the lot outside the Mountain Dens. Please
do not use empty sites for any purpose. No unlicensed vehicles, ATV’s,
golf carts, moped, electric scooters or electric skateboards are
allowed. There are area trail maps for ATV’s in the office.
13. Pets must be
kept on a leash, cleaned up after and not left unattended
outside units. No pets allowed in pool area, office, bathhouse or
other resort buildings.
14. Tenants will pay
their own-metered electric. No washing machines allowed in
unit. We have a laundry you can use.
15. Lot rent
includes the following services: Water, sewer garbage disposal
at the dumpster (only for trash generated at Happy Acres Resort),
discounted propane prices, road maintenance to the site, and all other
park amenities.
16. Tenants lot must
be kept neat, weeds and grass trimmed, leaves raked and disposed
of, exterior of buildings in good repair, only one shed per site, only
lawn furniture outside (no couches, chairs, etc,) No garbage or misc,
items outside, unit must have skirting. If there is a need for managers
to do upkeep on tenants lot there will be charges for their services.
17. All water
hydrants must be heat taped and insulated for winter use, if
this in not done and a hydrant freezes and causes breakage to the
hydrant, or any other damages, the Tenant will be held responsible for
any and all repairs.
18. Our pool is for
paying guests only. Pool passes will be given out on a
weekly basis with a different color for every week. You must come
to the office to receive your pool pass and only paying guests may use
the pool. Non-paying visitors are not allowed in the pool area
for any reason. You will only be able to enter the pool area with
a pool pass. Children under 13 must be supervised by and Adult
over 18. No life guard on duty, swim at own risk. Obey posted
pool rules or you may lose your pool privileges.
19. Alcohol
permitted only at your campsite, Excessive use will not be
tolerated. Underage drinking, or drug use will be reported to the
police, and offenders will be banned from the resort. We reserve
the right to remove you from your campsite without any refund.
20. Site
improvements are allowed at your own expense but must be
approved by owner of resort. Tenant must notify the office if replacing
unit. Additions or improvement to your unit are allowed at your own
expense but must be approved by owner of resort.
21. Do not remove
trees. Trees removed to accommodate you will be at your
expense and are the property of Happy Acres Resort. Do not take
wood from sites occupied or not. Management reserves the right to
remove trees or other objects on any site for safety or maintenance
reasons and temporarily disconnect any utilities with out notice.
22. Happy Acres
Resort and its owners and employees are not responsible for
damage, vandalism or theft of tenants unit or other personal
possessions.
23. Tenant agrees to
relieve Happy Acres and its owners and employees of any
responsibility of “Acts of God”. Tenant understands Happy Acres
and its owners are not liable, nor responsible to carry insurance
coverage on tenants unit, vehicle, or other personal property.
Tenant agrees to carry his/her own liability/comprehensive insurance
during the term of this lease; Tenant will furnish proof of insurance
to Happy Acres.
24. This property
being privately owned, the Tenant accepts resort privileges with
the understanding that he/she does hereby release the Happy Acres
Resort, its owners and employees of all liability for loss or damage to
property and injury to his/her person arising out of his/her use of its
resort facilities and agrees to indemnify Happy Acres Resort, its
officers and employees, against claims resulting from loss or damage to
property or injury to the person of any member of the family or guest
of the tenant, arising out of the use of its resort facilities.
25. The tenant
agrees to read and comply with all Happy Acres Resort rules and
regulations as provided to the Tenant and posted in the office.

29. All rules and
regulations of Happy Acres Resort are subject to change without notice
by owners; Happy Acres Resort reserves the right to inspect all
sites. Any tenant in violation of the rules and regulations will
forfeit their lease and all monies paid and will be required to leave
Happy Acres Resort immediately.
